Federal Judge Orders Freedom of Abrego Garcia from ICE Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was detained in federal detention.

In her decision, the court pointed out that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in Tennessee.

The court, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
